Who are targeted?

  1. Citizens of China and three other countries:
  •  “Resident alien” is a foreigner therefore treated differently from U.S. citizens ((§64-63(b)). To be an “resident alien”, someone needs to (a) have his/her primary home in the U.S. and (b) have the intent to remain there indefinitely ((§64-62(9)). They are allowed to acquire and hold real properties but can not lease ((§64-63(b))
  • Green card holders are considered “resident alien” and therefore, they can acquire and hold real properties but can not lease ((§64-63(b)). In addition, restrictions on registration and affidavit for non-citizens also apply to green card holders, resulting in green card holders being treated differently from citizens.
  • All temporary visa holders (student, work, L-1 visa, etc) are not “resident alien”, because under federal immigration law they cannot have the intent to remain in the U.S. indefinitely. Thus they are targeted by this law. They can’t acquire, lease, and hold real property.
  1. Government agencies of China ((§64-62(8)(b));
  2. Companies or other entities that are at least 33% controlled by the first two categories ((§64-62(8)(d)(2) and §64-62(11)).

What land cannot be bought, leased, or owned by the targeted people?

  1. All farm land (§64-63(a)); Or
  2. All land within 25 miles of military bases (§64-63(a)).
  3. This law lists ten military bases, plus any facility controlled by these ten military bases (§64-62(6)).
  4. If enacted, an estimated majority of the NC land will be under the regulation, including numerous residential areas.

Other provisions

  1. If a targeted person already owns the restricted land before the law becomes effective, he/she must register with the state (§64-63(c));
  2. If a targeted person buys or owns restricted land after the law becomes effective, he or she must sell it in 3 years (§64-63(e));
  3. Violations are subject to penalties including (a) $1,000 fine per day, and (b) Class 2 misdemeanor (§64-63(d) and (k)).
